Former Attorney General Daugherty was the first gnan to be brought to trial on a charge of conspiracy to defraud the government he served while a member of a president's cabinet. Daugherty and Miller, former alien property custodian, [?] were indicted for conspiring to defraud the government of their best services in permitting release in 1921 of $ 7, 000, 000 war impounded assets of the American Metal company. The case was given to the jury at 9: 43 o'clock Friday night. Saturday failure to agree was reported, but Judge Julian Mack insisted on further deliberation. Again yesterday the jury was told that not yet would anything but a verdict be acceptable to the court. At 3 o'clock today, however, the talesmen were called into the courtroom for the last time, and again reported inability to agree, whereupon Judge Mack said: " I shall not hold you longer, gentlemen. PLANTERS' MAIN HOPE IN BALANCED CROPS, KEYNOTE OF MEETING

Constructive Fearless Independent 12, 1926 14 PAGES Price 5 Cents PLANTERS ' MAIN HOPE IN BALANCED CROPS, KEYNOTE OF MEETING Better Understanding Among Interests Need, Says Duncan; Graves Favors Taking One-Third of Cotton From Market to Relieve Crisis A better balanced agricultural production in the South is badly needed, according to the almost unanimous opinion expressed in the sessions Monday of the regional agricultural conference at the state capitol. More than one hundred and twenty-five representatives of agriculture and other businesses from the states of Alabama, Georgia, Florida, Mississippi and Louisiana were present for the meetings. Speakers at both the morning and afternoon sessions Monday expressed the opinion that the South has raised too much cotton this year and that there is an especial need for diversification of crops. L. N. Duncan of Auburn, who presided at the conference, struck the keynote of the meeting when he declared that the great need in the South is for a better understanding by bankers, merchants and other business men of agricultural problems. Col. Bibb Graves, governor-designate at a luncheon at the Exchange hotel at 1 o'clock Monday said he believed the solution of the cotton price situation is the taking from the market of at least one-third of the cotton crop. Gen. Robert F. Ligon, president of the Montgomery Chamber of Commerce, called the conference to order and nominated Prof. L. N. Duncan of Auburn, as permanent chairman, he being promptly elected by acclamation. Introduces Brandon Prof. Duncan immediately introduced Governor W. W. Brandon, who welcomed the visitors to Alabama and to Montgomery. Another address of welcome was delivered by Mayor W. A. Gunter, Jr., of Montgomery, after which the discussion of the day began. Agricultural problems and financing were the main subjects considered, marketing being left for consideration Tuesday, the last day of the conference. William Harper Dean, manager of the agricultural section of the chamber of commerce of the United States, made a brief explanation of the purpose of the conference during which he insisted that each section of the United States has agricultural problems peculiar to itself and that this is why the chamber of commerce has arranged its series of regional conferences, of which that in Montgomery is the fifth. Mr. Dean expressed doubt rgarding a national agricultural problem unless it be the disparity between what the farmer gets for what he sells and the price he pays for what he buys. There were no set speeches and each person present was given an opportunity to express himself and to make any contribution to the conference. During the day the agricultural situation in Alabama, Georgia, Florida, Louisiana and Mississippi was thoroughly analyzed and redies offered for the disastrous condition in which farmers now find themselves. County Agents Praised The agricultural colleges and the county agents were commended for their introduction of improved methods which have resulted in a bumper cotton crop but the farmers, bankers, agricultural leaders and chamber of commerce officials present agreed that (Continued on Page Three) MUST PAY CLAIM, COURT DECLARES Insurance Firm Loses Fight to Keep From Paying For Cotton Burned at Athens ELLIS DECLARES SOUTH HOLDS KEY TO COTTON CRISIS Vice-President of United States Chamber of Commerce Says Warehousing and Loans Solution to Situation BIRMINGHAM, ALA., Oct. 11. - Special to The Advertiser. - Declaring that the situation caused by the decline in the price of cotton, while serious, is not fatal and that the South holds within its hands the solution to its problems without asking aid of the federal government, Robert R. Ellis, vice-president of the United States Chamber of Commerce, tendered the principal address at a banquet tendered a group of directors of this organization at the Southern club Monday night by the Birmingham Chamber of Commerce. The proper method of warehousing, and the use of loans from southern bankers was the plan proposed by Mr. Ellis for use of the Southern farmer in tiding over the economic situation caused by the market decline following the hurricane. " There is no need for the South to appeal to the federal government for aid. With a systematic warehousing program and the business-like use of loans offered by bankers on cotton the farmers of the South can weather the storm and solve their own problem, " Mr. Ellis declared. " There are many more important crops to be raised in the South than cotton. Diversified farm products raised in the South are three [?] of greater importance than the cotton crop, " he continued. The storing of cotton in bonded ware houses until the price reaches a more advantageous figure and the use of law interest loans offered by bankers of the South in order to carry the planters over until next year was recommended by the speaker who discussed the cotton situation minutely. " The situation is not as serious as it has been and the South, with its great progressive strides, can stem the tide and solve her own problems created by the low price of cotton, " he continued. Mr. Ellis, accompanied by W. M. Howze, Wichita, Kansas, Frank Knell, Wichita Falls, Texas; Louis Lipsitz, Dallas and J. G. Leigh, Little Rock, members of the board of directors of the national organization, arrived in Birmingham Monday from Nashville. They were the guests of the Birmingham chamber at the banquet. Mr. Ellis is a prominent wholesale druggist of Memphis, Tenn., and said to be well in touch with the general situation in cotton growing states. Mr. Ellis and other directors were scheduled to leave Birmingham late Monday night for Montgomery where they will meet in connection with the regional agricultural conference to
