The austerity column admits a shipping-sector objection that consolidation may overload the minister. The attack commentary distinguishes political opinion from participation in a plot while defending France’s treatment of Italian migrants. A reproduced colonial report links court reorganization to shifting administrative powers from provinces to districts and changing who presides over each judicial level; its favorable assessment belongs to the administration.

Not easy
It is not only deputies—some of them, at least—who are complaining. Here is a protest published in La Pêche Maritime; this one, at least, is reasonable:
“Shipping and fishing circles learned with deep concern of the abolition of the Merchant Marine undersecretariat. Mr. Poincaré has returned to the arrangement of his second ministry in 1924. The minister then, Mr. Le Trocquer, personally directed the services on the rue du Trocadéro, which remained grouped together. Mr. [illegible], of his staff, was specially charged with maintaining liaison between the former undersecretariat and the boulevard Saint-Germain.
“Mr. André Tardieu will therefore also be minister for the Merchant Marine, Ports and Fisheries. We know he is very well prepared for this task, but fear that even for a man of his energy and intelligence the burden will be overwhelming. The Merchant Marine undersecretariat has long ceased to be merely an undersecretariat. Its services in fact constitute a ministry, which sooner or later will have to be created. We ask Mr. Tardieu never to forget this logical and simply postponed outcome as he takes charge of the French merchant fleet and maritime fishing.—H. M.”
Concerning an attack
There are not only active antifascist immigrants in France. There is a veritable army of workers who, unable to find employment in Italy, came to France, where many of them, especially in the south, have lived for years.
An offence of opinion does not exist here—in principle. Being antifascist is not enough to justify handing people over to the Italian government. It would be quite different if the government, or rather its police, informed of an organized plot, succeeded in neutralizing its participants and could rid our territory of them. France is hospitable, but it is by no means willing to shelter the organizers of attacks. It demonstrated this very recently by arresting the authors of a plot against the life of the king of Spain, then a guest of France.
Reorganizing colonial courts for Madagascar’s indigenous population
Under the present regulations, districts have only a court of first instance, while the court of second instance sits in the provincial capital.
Article 118 of the decree of May 9, 1909 does provide that the governor-general may establish courts by order in centres other than the capitals. But since the decree is silent on the composition of those courts, it does not appear possible to use this provision for a reform as extensive as that envisaged by the local administration.
The text submitted to you therefore expressly provides for courts of second instance in places other than provincial capitals, chaired in such cases by the chief of the district where the court sits.
Furthermore, to free the heads of the new provinces from all judicial duties, the proposal allows the same arrangement, where appropriate, for courts sitting in provincial capitals.
As the district chief cannot preside over courts of both first and second instance at the same time, new arrangements for courts of first instance also had to be considered.
The proposal therefore provides for courts of first instance chaired by assistants to district chiefs, replaced where necessary by officials of the indigenous administration. This last measure is particularly timely: it puts into practice, prudently and without risk, the principles of association on which our indigenous policy rests, while easing the burden on administrators excessively absorbed by their judicial duties.
Context
A smaller government could leave the same workload
Abolishing an undersecretariat removed a separate political office, but the shipping and fishing services still needed direction. The protest therefore asks how one minister could absorb the work and argues that the sector already required a ministry in substance. Its appeal to Tardieu’s ability sharpens the point: the objection is to the structure and scale of responsibility, even under a capable minister. This is the practical side of administrative retrenchment as seen by an affected industry.
Distinguishing political refuge from a violent plot
The commentary on immigrants resists treating all Italians in France as a single political threat. It begins with the economic motive for migration, then argues that antifascist opinions alone should not trigger surrender to Italy. At the same time, it endorses police action against organized attacks. The author’s defence of hospitality is therefore conditional: freedom to hold an opinion is separated from permission to plan violence on French soil.
Judicial reform within a colonial chain of command
Madagascar had been a French colony since 1896. The proposed courts in this report remained inside an administrative hierarchy: district chiefs would preside at the second level, with their assistants at the first. Moving courts beyond provincial capitals could change where cases were heard, but the personnel arrangements kept judging tied to colonial administration. The proposal’s praise of “association” explains the reform in the rulers’ terms, especially their wish to redistribute officials’ workloads.

Organisation de la Justice Indig ène à M adagascar
Avec la réglementation actuelle, en
effet, les districts ne disposent que d'un:
juridiction du ter degré, la juridiction
du 2e degré siégeant au chef-lieu de ia
province.
L'article 118 du décret du 9 Mai 1909
