The Third Court of Appeals, to which Dr Horacio B. Oyhanarte, defence counsel for María Poey and councillor Pereyra, had submitted a writ of habeas corpus, rejected counsel’s application for release in the following decision, signed by Drs Alsina, Machado and Arósteguy, through the registry of Dr Víctor M. Fernández.
Decision of the Court:
“As the documents in the principal case before the Court (folio 169 and preceding folios) establish the applicants’ release, their freedom having been obtained through other avenues, and having regard to Article 431 of the Code of Criminal Procedure, the application for habeas corpus is denied.”
Did Elisa confess everything?
A sensational rumour is circulating:
A senior employee who has been in the office adjoining that of Judge Facio tells us that, in the statement she has just given, Elisa García confessed her participation in the killing of Dr Ray, providing every detail of that dreadful tragedy.
The fact that councillor Pereyra was questioned immediately after the maid gave her statement would seem to corroborate this assertion.

Why release could accompany rejection of a petition
The printed ruling explains that Poey and Pereyra had already obtained their freedom through other procedures. La Cámara Tercera de Apelaciones a la cual el doctor Horacio B. Oyhanarte, abogado defensor de María Poey y del concejal Pereyra, había elevado recurso de “habeas corpus”, denegó el pedido de excarcelación interpuesto por el letrado, en la siguiente resolución que aparece firmada por los doctores Alsina, Machado y Arósteguy, por la secretaría del doctor Víctor M. Fernández.
Resolución de la Cámara—
“Resultando de las constancias de los autos principales que el Tribunal tiene a la vista (hojas 169 y anteriores) la excarcelación de los recurrentes, obtenida su libertad por otras vías y atento a lo dispuesto en el artículo 431 del Código de Procedimientos en lo Penal no ha lugar al recurso interpuesto de ‘habeas corpus’.”
¿Elisa Confesó Todo?
Corre un rumor sensacional:
Un alto empleado, que ha permanecido en el despacho contiguo al del juez, doctor Facio, nos comunica que en la declaración que acaba de prestar Elisa García ha confesado su participación en el crimen del doctor Ray, dando todos los detalles de aquella espantosa tragedia.
Pareciera corroborar esta afirmación, el hecho de que inmediatamente de deponer la mucama, ha sido interrogado el concejal Pereyra.
