The third attempt on Benito Mussolini’s life has revealed the urgent need to clarify Italian–French relations over the accommodating hospitality the neighbouring republic offers Italian exiles and the indifference French authorities show toward the criminal activity of Italian and French anti-Fascists, united by Masonic, anarchist and socialist-communist solidarity. No one dares doubt that Gino Lucetti’s attack is the fruit of that criminal political climate created in Paris, on the Côte d’Azur and in Marseille by the propaganda of Italian–French anti-Fascist leagues, and especially by the activity of Italian exiles.

What should and can be the limits of the supreme penalty’s application, and for which crimes? Crimes against the state and its constitution, and those of an evidently anti-social character, must be punished with death. It follows logically from these principles that anyone attacking the life, liberty or bodily integrity of the King, the Queen or the Crown Prince—in whose persons the tradition and integrity of the monarchical order are perpetuated—must be punished with death. The same penalty must apply to anyone committing an equivalent crime against the head of government, the person responsible for the nation’s policy and direction.

These ratifications were delivered this morning, without any special ceremony, by His Excellency Scialoja for Italy, de Brouckère for Belgium, Chamberlain for Britain, Briand for France, Zaleski for Poland and Beneš for Czechoslovakia. The completion of this final act has not been accompanied by a definitive resolution of the crisis that has troubled the League since last May: very little remains to be done, but discussion continues for now.

Context

Why an assassination attempt became a dispute with France

Mussolini’s movement had turned Italy into a dictatorship, while opponents abroad continued to challenge it. The lead seeks to make the host country responsible for that opposition by joining hospitality, political propaganda and the attack into a single chain of blame. This gives Rome a reason to demand restrictions beyond its own borders. The conflict is therefore also over whether France’s treatment of exiles should be governed by its own choices or by Italy’s demands for protection of the regime.

Why the proposal places the head of government beside the royal family

The death-penalty argument moves from protecting the monarchy’s continuity to protecting the person directing government policy. That comparison elevates an attack on Mussolini into an attack on the state’s order, even though he is head of government rather than king. The broad category of “anti-social” crimes extends the reasoning beyond a single attempted assassination. Personal security becomes a basis for arguing that the state needs a wider and harsher power to punish.

Why Locarno could take effect while the League still argued

The treaty’s entry into force on September 14 completed a defined diplomatic process. The League’s Council arrangements involved a different task: distributing permanent and elected influence among member states. In 1926 the elected seats increased to nine, alongside Germany’s arrival as a permanent member. Completing the treaty documents therefore did not itself settle every institutional dispute. The closing sentence places a diplomatic milestone within continuing negotiations over how collective security would be governed.

Il terzo attentato contro Benito Mussolini ha rivelato l'urgente necessità di chiarire i rapporti italo-francesi nei riguardi della compiacente ospitalità che la vicina Repubblica offre ai fuorusciti italiani e alla indifferenza che le autorità francesi dimostrano verso la criminosa attività degli antifascisti italiani e francesi, affratellati dalla solidarietà massonica, anarchica e social-comunista. Nessuno osa mettere in dubbio che l'attentato di Gino Lucetti sia frutto di quel clima politico criminale, che a Parigi o sulla Costa Azzurra, a Marsiglia è stato creato dalla propaganda delle leghe antifasciste italo-francesi e segnatamente dall'attività dei fuorusciti italiani.

Quali debbono e possono essere i limiti di applicazione della pena suprema e per quali delitti? Con la morte debbono essere puniti i delitti contro lo Stato e la sua costituzione e quelli che rivestono evidente carattere di antisocialità. Da questi concetti deriva, come logica conseguenza, che chiunque attenti alla vita, alla libertà, alla integrità del Re, della Regina, del Principe Ereditario, nelle quali persone si perpetua la tradizione e integrità dell'ordinamento monarchico, debba essere punito con la morte. A medesima pena deve soggiacere chi compie eguale delitto contro il Capo del Governo contro la persona che ha la responsabilità della politica e della direzione della Nazione.

La consegna di tali ratifiche ha avuto luogo stamane, senza alcun particolare cerimoniale, da parte di S. E. Scialoja per l'Italia, di De Brouckère per il Belgio, di Chamberlain per la Inghilterra, di Briand per la Francia, Zaleski per la Polonia, Benes per la Cecoslovacchia. Il compimento di quest'ultimo atto non è stato accompagnato dalla risoluzione definitiva della crisi che travaglia la Società fino dal maggio scorso: ci manca pochissimo, ma intanto si continua a discutere.
