Vossische Zeitung

This Vossische Zeitung front page paired a political crisis abroad with two disputes at home. A dispatch from the Spanish border reported that the Liberals Romanones and Villanueva had protested to Alfonso XIII that Primo de Rivera's planned National Assembly would breach the constitution, and that artillery officers were secretly circulating defiant leaflets. It judged the throne to be in danger but expected the King to sign the convocation decree anyway. An unsigned editorial expected Prussia's settlement with the Hohenzollerns to pass on Friday. It defended the deal as the Braun government's least-bad option and faulted the SPD for only abstaining. Arthur Eloesser attacked the pending youth-protection law against 'trash and smut', arguing that adding state review boards would let local moral zeal censor serious literature across the Reich.

Spain's Constitutional Crisis

The Liberals protest to the King / Strong agitation in the army / Convocation of the National Assembly?

Hendaye (Spanish frontier), October 13. Vossische Zeitung news service.

Copies are circulating of the letter of protest addressed by the Liberal Party to King Alfonso of Spain and signed by Romanones and Villanueva. It is directed against Primo de Rivera's plan for a National Assembly and points out to the King the breach of the constitution that would result from convening the National Assembly. In addition, leaflets from the artillery officers are being distributed in secret, justifying their giving way in the last conflict on the grounds that they wished to avoid bloodshed. They do not regard themselves as defeated, nor as excluded from the army. This notice also contains sentences directed against the King. The pending artillery conflict has grown sharper in recent days because salary payments to the officers ceased as of October 1.

Judging by Primo de Rivera's latest speeches, he will not give way and will not abandon the National Assembly. The decision rests with the King alone, who already stands somewhat at odds with Primo de Rivera, but not sufficiently, since he would otherwise have to dismiss him. As a result, the throne is at present in great danger: first, from a republican uprising that could originate in the army, where the agitation is growing ever stronger; second, because a later parliament, after a strong reaction to the left, could prove against the King the grave breach of the constitution committed by Primo de Rivera with the King's tolerance. The situation is very serious. The present impression is that Alfonso XIII will sign the decree convening the National Assembly despite the danger, since he considers Primo strong enough to protect both himself and the King.

Madrid, October 13. Vossische Zeitung news service.

The King leaves tomorrow for three weeks in Barcelona, accompanied by Primo de Rivera.

The Decision of the Governing Parties

The final disposal of the settlement that the Prussian state government has concluded with the representatives of the Hohenzollern family is to take place on Friday. No thorough discussion of the substance took place in the first two readings. And by parliamentary custom the third reading counts more as a formal confirmation of the preceding resolutions than as an occasion to reopen individual questions. There can be no doubt of a smooth passage. The settlement, which has already been provisionally signed, will become law.

For the opponents of the excessive princely claims, it is no longer a matter, at this stage, of discussing what ought to have happened earlier and what mistakes were piled up as recently as this spring. What is decisive, rather, is the fact that the Prussian state government, under the leadership of the Social Democratic Minister-President Braun, regards the conclusion of the settlement as the least evil and takes the view that, under the given circumstances, the Prussian state will fare better with the settlement than with a continuation of the present state of uncertainty over property rights. It is in the nature of the parliamentary system that on so important a question the parties stand behind the dutiful decision of their trusted representatives in the cabinet. The Democratic members of the Landtag are acting on this principle, even though they are well aware that it is a "bitter pill." That two deputies of the Democratic group voted against the bill contrary to the line that had been issued — they are Deputies Greßler and Hermann — must be disapproved. After all, it is clear that the majority of the Democratic group, which decided for acceptance, also fully appreciates the objections to numerous details of the settlement. Nor does approval of the bill by any means signify approval of these details; it merely expresses the conviction that the Prussian state government has extracted the best that could conceivably be obtained from the negotiations.

The strongest governing party, Social Democracy, to be sure, does not acknowledge the duty to give its full support to the cabinet it sustains. It contents itself with the half-measure of abstention. In doing so it by no means disarms the Communist attacks. Still, its present attitude signifies a certain distancing from the close association with the Communists that Social Democracy entered into at the referendum, to its own harm and to the harm of the cause. It may be doubted that the Communist uproar will make a stronger impression on the masses. In any case, Social Democracy has every reason not to let itself be diverted by momentary local currents from the broad course that it has kept in the service of the Republic through the years of collapse and recovery.

The Law against Trash and Smut

By Arthur Eloesser

What is trash and smut? The law, whose second reading is imminent, includes under this collective name "writings intended for mass distribution, without artistic or scientific value, which by form and content have a brutalizing or demoralizing effect, or from which a harmful influence on the moral, intellectual or physical development of the young, or an overstimulation of their imagination, is to be feared." How is trash and smut to be fought? By entering the writings so characterized in a Reich trash list, which, incidentally, already exists and was submitted to the Reichstag together with the law by way of example. The writings marked by the list may neither be offered for sale nor advertised, whether in a fixed place of business or by itinerant trade; they may not be displayed inside sales rooms, in shop windows or at other places visible from the street; they may neither be offered for sale to persons under eighteen nor handed over to them in the course of trade. — And there is much else they may not do.

The trash and smut law was originally the child of quite respectable and honestly concerned parents. The parties of the Weimar coalition, which preserved the Republic and with it the Reich, brought it into the world with the support of well-meaning teachers' and youth-education associations, in order to protect our youth, after the fatherless years of war and after the crises of revolution and inflation, from demoralization and brutalization, perhaps even from being made stupid. Even if one could easily imagine that more would have been done for our youth in precisely this respect by improving housing conditions, by adding playgrounds, by building swimming baths, by supplying cheap good reading, one could still reassure oneself with the prospect: if the law does not help much, it will not be able to do much harm either. This ironic neutrality is no longer permissible today. If exactly a hundred years ago a great scholar of constitutional law said that we had lost the talent for legislation, that talent seems to have become entirely impossible to find precisely today. Since the proposals for improvement made by writers and publishers received only slight attention, this law will fare no differently from the Law for the Protection of the Republic, which recoiled upon its own authors; and at the shape it has taken after the negotiations of the parties, of all the parties, with the government, its original begetters can only cross themselves. But that is a changeling! Our child looked quite different. — And they should have the courage to disown it before the deformity that can confidently be expected outgrows them, head and limbs.

How has the law degenerated and thereby become unacceptable? Originally only one central review board was to be charged with drawing up the trash and smut list for the Reich: one German morality, one German youth, one German concern, one trash and one smut. But the states, as is well known, begrudge the Reich everything, and especially where there is something to prohibit. So the review boards of the states got into the law, and so we again get the Prussian and the Saxon, the Bavarian and the Mecklenburg, the Württemberg and the Hesse-Darmstadt morality, each of which quite jealously cultivates its legitimate peculiarities. Even today, without the law, a pretty game of football is being played with German artists and writers. A book is indicted, say, for blasphemy in Prussia. The Prussian judge finds nothing wrong with it. Thereupon one can assume with certainty that the same charge will turn up before, say, a Bavarian or Mecklenburg court, and the good Lord of Bavaria or of Mecklenburg receives the satisfaction denied to the Prussian one. But every seizure extends its effect to the whole Reich. Even if the state review boards provided for trash and smut depend on a qualified majority, even if the expert assessors are to be supplied by the organizations of letters and the book trade, of the teaching profession and of youth welfare, one can guess how a chairman familiar with local conditions can put together his board and qualify his majority. And anyone who has ever had to do with such trials also knows what black mania for sniffing about, for informing on personalities and associations, is going through Germany, what strange kind of vindictiveness is awake against everything that looks like real art and literature. It is very much to be feared that even the higher instance of a Reich review board, which the law concedes, will by those of the …

Context

Why Primo de Rivera's National Assembly was called a breach of the constitution

Alfonso XIII had already set the constitution aside once: on 14 September 1923 he declared his support for Primo de Rivera's coup, dismissed the civilian government and suspended the 1876 constitution. With the creation of the Civil Directory, Primo rejected the return to a parliamentary system he had promised in 1923 and created a National Assembly in which corporate interests rather than individual voters were represented. The Liberal protest reported here treated convening such a body as a further breach of that suspended constitution. Its signatory Romanones had already joined conspirators who aimed to re-establish the 1876 constitution and reconvene the parliament suspended in 1923, and after their rising failed in June 1926, Primo fined him 500,000 pesetas. The protest therefore came from a politician already punished for pursuing the same goal. The correspondent's judgment that the King, despite some friction, would stay with Primo matches the historian Gabriel Cardona's account that Alfonso, who knew of the June plot, chose to bet on Primo as the safer and more comfortable option. The paper's warning that the throne itself was at risk proved well founded in the longer run: as the army's grievances grew, the King stopped supporting the dictatorship, Primo resigned in 1930, and his successor Berenguer governed only until the Second Republic was established in 1931.

What divided the artillery officers from the dictatorship

The artillery officers' quarrel with the regime centred on promotion. The artillerymen defended a 'closed scale' under which promotion depended solely on seniority, while a decree published on 9 June 1926 unified the promotion systems of the armed forces. Most of the officers involved in the June 1926 conspiracy against Primo de Rivera came from the Artillery Corps and opposed that decree. The clandestine leaflets described in this dispatch, in which artillery officers justified backing down to avoid bloodshed and included lines against the King, belong to this continuing conflict; the claim that officers' pay was stopped from 1 October is the correspondent's own report. The paper's fear of a republican rising from within the army also had a real basis. Among the June conspirators, younger officers such as Major Ramón Franco and Captain Fermín Galán went further than restoring the old constitution and called for proclaiming a republic.

What the Prussian settlement with the Hohenzollerns brought to an end

The dispute went back to the revolution of 1918/19, when the property of the former princely houses was seized but not expropriated. Because Article 153 of the Weimar Constitution guaranteed private property, the princes demanded large financial compensation. When the Communists campaigned to expropriate them, the SPD leadership, mindful of high unemployment and the mood among workers, backed the Communist initiative. After the referendum failed on 20 June 1926, most state governments reached financial compromises with their former dynasties fairly quickly, and in Prussia the settlement between the state and the House of Hohenzollern came about on 15 October 1926, the Friday this editorial anticipated. The paper's complaint about Social Democratic abstention reads against that history: only months earlier the SPD had campaigned alongside the KPD for expropriation, so voting for a compensation agreement negotiated by its own Minister-President Braun would have sat awkwardly with that campaign. The editorial read the abstention as a partial retreat from the alliance with the Communists, yet still insisted that a governing party owed its cabinet full support.

How the trash-and-smut bill became law and what became of it

The law Eloesser attacked had been proposed at a cabinet meeting on 19 December 1923; the Reichstag passed it on 3 December 1926, and it took effect on 18 December 1926, so this column appeared about seven weeks before the final vote. The enacted law left listing decisions to review boards, each made up of an official chairman and eight experts, two each drawn from art and literature, the book and art trade, youth welfare and the teaching profession. Those affected could apply for removal from the list to a higher board set up in Leipzig. That structure of several boards beneath a single Reich appeal body corresponds to the arrangement Eloesser described. Writing in Legal Tribune Online, Martin Rath points out that the seven-paragraph statute contained no definition at all of what the boards were meant to restrict, so the definition Eloesser quoted from the bill did not survive into the enacted text. The historian Margaret F. Stieg concludes that within ten years the law was a dead letter, replaced by the 1935 guidelines of the Reichsschrifttumskammer.

Verlag und Schriftleitung: Berlin SW68, Kochstr. 22-26 Spaniens Verfassungskrise Die Liberalen protestieren beim König / Starke Agitation im Heer / Einberufung der National-Versammlung? ✱ Hendaye (Spanische Grenze), 13.
