- The mining question in England
This front page of L'Écho annamite was dominated by the quarrel that followed Cochinchina's Colonial Council elections. An editorial signed N. Q. N. attacked the Courrier Saigonnais for declaring Bui-quang-Chiêu, Nguyên-van-Thinh and Trân-van-Dôn ineligible and for announcing a runoff for M. Binh, quoting the decree of 9 June 1922 to argue that votes are counted against ballots validly cast and that only the Conseil du Contentieux and the Conseil d'État, not the vote-tallying board, could rule on eligibility. A second editorial used Pius XI's consecration of Chinese bishops to contrast the Church's treatment of non-white clergy with France's treatment of Annamites. Wire items covered France's 1927 draft budget, possible troop cuts in the Rhineland, and British Labour and miners' resolutions on the coal dispute.

The case of MM. Bui-quang-Chiêu, Nguyên-van-Thinh and Trân-van-Dôn
The Courrier Saigonnais's original way of interpreting the texts
In the Courrier Saigonnais of 13 October one reads, in large type and on the front page: “The native elections — Three cases of ineligibility and a runoff.”
This refers, obviously, to MM. Chiêu, Thinh and Dôn and to M. Binh.
The Courrier Saigonnais writes: “If one goes by the figures already published, there will be a runoff in the 5th constituency, where M. Binh obtained only 1312 votes; he is 8 votes short of half the number of voters.”
Excuse me, dear colleague: half the number of votes cast.
Let us consult, if you please, the organic texts of the Colonial Council, in this instance the decree of 9 June 1922. In the chapter on “elections” you will read:
“Art. 19. — In the first round of voting, no one is elected unless he has obtained: 1. An absolute majority of the votes cast; 2. A number of votes equal to one quarter of the electors registered in the college to which he belongs. The number of votes cast is obtained by deducting from the number of voters that of blank and spoiled ballots.”
And further: “When the votes are counted, no account shall be taken of ballots bearing the names of persons whose declaration of candidacy was not made within the prescribed time limits.”
So much for your “runoff”!
As for the case of MM. Chiêu, Thinh and Dôn, you write: “If one goes by the texts organizing the Colonial Council, three of the candidates who obtained a majority are ineligible. They should therefore not be proclaimed elected, and the ballots bearing their names should be declared void.”
No, once again! An erroneous interpretation! But you are excusable, colleague; one can see that you studied law only by hearsay. Texts are not interpreted that way.
Ineligible? First, you forget to say why. Next, the cases of ineligibility are exhaustively laid down by the aforesaid decree. They concern: 1. Officials or agents of the Administration paid from the various budgets; 2. Contractors; 3. Persons under legal interdiction.
You find a fourth category of ineligible candidates: naturalized Frenchmen who did not opt, within the prescribed time limits, for the native electoral college. And you rest your thesis on a precedent drawn from heaven knows where: the case of a woman standing in an election in which women are ineligible.
You simply forget that MM. Chiêu, Thinh and Dôn do not belong to the fair sex, but rather to the category of candidates covered by Article 8 (2nd paragraph) of the organic decree, which reads: “However, natives born in Cochinchina and admitted to the status of French citizens, or their descendants, who wish to use the option granted to them by Article 11 of the present decree to be entered on the native electoral rolls may not at the same time be electors to the Colonial Council in the French electoral college.”
MM. Thinh, Dôn and Chiêu did not opt for the Annamite electoral college within the prescribed time? Granted! But only the Conseil du Contentieux and the Conseil d'État are competent to rule on their case. The general vote-tallying board has nothing to do with it. The texts say, in fact: “The general vote-tallying board is not competent to rule on questions of eligibility and incompatibility; it would exceed its powers if it failed to proclaim elected the candidate who obtained the majority of votes on the ground that this candidate is ineligible. This holds even if the elected candidate died on the eve of the election: even in that case the board is not to rule on the ineligibility of this candidate; it must proclaim him elected, and his replacement must be carried out by a new election.”
So read the texts before talking about them, gentlemen of the Courrier Saigonnais.
If MM. Thinh, Dôn and Chiêu did not vote for the Lachevrotière list, is that sufficient reason to hold it against them... and to extend the powers of the general vote-tallying board?
No, surely not?

RACIAL PREJUDICES TO BE OVERCOME
We recently reprinted an article by M. Albert de Pouvourville on this sensational event: the consecration by Pope Pius XI of three Chinese bishops. We drew from it the conclusion that seemed right to us and pointed out that the Catholic Church makes no distinction between the white race and the coloured races and that, in this, it shows itself far more liberal than France, for example, towards the natives of her colonies, and in particular towards the Annamites.
The lines below, taken from La Vie Catholique, prove that the capital reform, or more exactly the important innovation achieved on this occasion by the Holy See, far from meeting opposition from the high clergy, was unanimously approved by it.
Can the same be said of the colonial government when it comes to the wishes of the native populations of Indochina, whose soundness everyone is pleased to acknowledge, but whose fulfilment is constantly judged premature?
Editor's note.
The coming 24 October will rank among the memorable dates in the history of the missions, and, one may add, in the history of the Church. On that day His Holiness Pius XI will consecrate with his own hands, in Rome, amid the splendours of St Peter's Basilica, the first three […]
“Would you see him as a missionary? Go among the savage Bahnars of inner Cochinchina or into the jungles of Tonkinese Laos; you will see him alongside our French missionaries, courageously making up for their small number and, like them, doing the work of an apostle.

Context
Who Chiêu and Thinh were, and why their eligibility was questioned
The editorial defends men who had just won seats in the native college of the Colonial Council. Bui Quang Chieu was the leader of the moderate-nationalist Constitutionalist Party, and his return from France on 21 March 1926 coincided with the arrest of the journalist Nguyễn An Ninh. Nguyễn Văn Thinh was a French citizen who joined the Constitutionalist Party in 1926. That legal status is what the Courrier Saigonnais's argument, as the editorial reports it, turned on: naturalized Frenchmen who had not opted in time for the native college were, in the rival paper's view, ineligible for it. N. Q. N. does not dispute that the option was late; he argues only that the general vote-tallying board could not act on it and that the question belonged to the Conseil du Contentieux and the Conseil d'État. Thinh's later career shows how prominent such French-citizen reformers would become in southern politics: on 26 March 1946 he became chief of Cochinchina's provisional government, and on 1 June its provisional president.
The 1922 decree and Cochinchina's two electoral colleges
The articles quoted in the editorial describe a Colonial Council chosen by two separate colleges, one French and one native. Article 8, as N. Q. N. cites it, allowed Cochinchina-born natives who had become French citizens, and their descendants, to register on the native rolls under Article 11, but then barred them from also voting in the French college; Article 19 set the first-round thresholds of an absolute majority of votes cast and a quarter of registered electors. The principle of giving Vietnamese some role in the colony's affairs went back to 1879, when Le Myre de Vilers arrived in Saigon as Cochinchina's first civilian governor, carrying instructions in which Admiral Jauréguiberry noted its desirability. Hue-Tam Ho Tai's study of the 1922 electoral reforms treats them together with the Constitutionalist Party, and her references include R. B. Smith's work on Bui Quang Chieu and the party from 1917. The option clause became the point of contention because it made naturalized men like Thinh choose between the two colleges.
Saigon's politics in the spring of 1926
The election quarrel came after an agitated spring in Saigon. Nguyễn An Ninh's arrest on 21 March 1926 coincided with Chieu's return from France, and on 4 April an unprecedented demonstration against the government took place, when seventy thousand people paraded with the funeral cortege of Phan Châu Trinh. Thinh began his political career as a Constitutionalist by holding Phan Chu Trinh's funeral ceremony. Of the men the Courrier Saigonnais wanted disqualified, Chieu and Thinh therefore belonged to a reformist current that had just shown it could draw crowds. The editorial's closing gibe, that the three had not voted for the Lachevrotière list, presents the challenge as political retaliation by the opposing camp.
Pius XI's Chinese bishops and the editorial's comparison
The event the editorial seizes on was the consecration in Rome of the first Chinese Catholic bishops of modern times. Joseph Hu Ruoshan, one of the first six, was consecrated by Pius XI on 28 October 1926, and the Holy See framed these consecrations as an important moment for indigenizing the Church. Writing two weeks earlier, L'Écho annamite and the Vie Catholique text it reprinted speak of three bishops and of 24 October, figures that do not match the six bishops and the 28 October date recorded for Hu Ruoshan's consecration. The paper turns the news into an explicit political argument: if Rome could entrust bishoprics to Chinese priests with the unanimous approval of the high clergy, the editors asked, why did the colonial government keep judging Annamite demands premature? The reprinted fragment itself still places native clergy “alongside our French missionaries” among the Bahnars and in Laos, so the Church's indigenization was presented within a French missionary framework.
